Terms of service

These terms are an agreement between you and Barakat Labs ("we", "us"), the maker of Listenback. By using Listenback you agree to them. If you use it for a company, you agree for that company.

1. What Listenback is

Listenback turns a recording of your sales call into a written coaching review. By default we transcribe the call on our own system, and the review is then created by AI from the transcript text only. If we later use a cloud speech provider, we will list it on our subprocessors page first.

2. Your account

Eligibility: you must be 18 or older.
Your details: give us an email address you control, and keep your login links private.
Your activity: you are responsible for what happens in your account.
Team and coach accounts: the account owner is responsible for the members they invite and for their uploads.

3. Recording consent: your responsibility

Recording laws differ by place. Some US states, including California, Florida, Illinois, Pennsylvania and Washington, require everyone on a call to agree to it being recorded.

Before every upload, you promise that:

you have the right to record the call and to upload it to Listenback;
everyone on the call was told it may be recorded, and you got any consent the law requires;
uploading and processing the call does not break any law or anyone's rights.

What this means for us:

We cannot check this for you. By ticking the consent box on each upload, you confirm it for that call.
You cover claims you cause. You agree to cover our costs and losses, including reasonable legal fees, if someone makes a claim against us because you uploaded a recording you were not allowed to record or share.

4. Your content

You own it. You keep ownership of your recordings, transcripts and reviews.
What we may do with it. You let us process your content only to provide Listenback to you: to transcribe it, review it, store it for the periods in our privacy policy and show it to you.
No training. We do not use your content to train AI models, and we do not let our providers do so.
Your responsibility. You are responsible for your content and how you use your reviews.

5. Acceptable use

Do not use Listenback to:

upload calls you were not allowed to record or share, or calls that contain someone's payment card, bank or medical information;
harass, deceive or pressure anyone;
break any law, including telemarketing, call-recording and privacy laws;
try to break, overload, copy or get around limits in the service, including the free-review limit.

We may suspend or close accounts that break these rules.

6. AI reviews: no guarantees

Reviews can be wrong. They are created by AI and can be inaccurate or incomplete. Check anything important against your own recording.

A review is coaching, not:

legal advice;
financial advice;
compliance advice;
professional advice of any kind.

No promise of results. Using Listenback does not promise any deal, contract, income or result.

7. Plans, talk time and payment

Gumroad: payments are processed by Gumroad, which sends your receipt.
Metering: talk time is counted per minute of audio, rounded up.
Monthly plans: minutes reset each billing month and do not roll over.
Top-ups: top-up minutes do not expire. Monthly minutes are used first.
Failed reviews: if a review fails, its minutes are not charged.
Waiting reviews: reviews are usually ready in minutes. If our transcription system is offline, uploads wait in a queue and may take longer. Minutes are only charged when a review is complete.
Price changes: we may change prices for future billing periods. We will tell you before a change affects a plan you have.

8. Cancellation and refunds

Cancelling: you can cancel a monthly plan at any time. It stays active until the end of the period you paid for and then stops.
Refunds: payments are not refunded, including unused minutes. The exception is when Listenback failed to deliver what you paid for and we could not fix it. Refund decisions are made by Barakat Labs. To ask, reply to your receipt or email hello@barakatlabs.com.
Card disputes: if you dispute a charge with your card provider instead of contacting us, we may suspend the account while it is resolved.

9. Ending your account

Your choice: you can delete your account at any time. We then delete your reviews and transcripts as described in our privacy policy.
Our choice: we may suspend or end an account that breaks these terms, or if we stop offering Listenback. If we stop the service, we will give reasonable notice where we can.

10. Disclaimers and limit of liability

No warranties. Listenback is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, including fitness for a particular purpose and that the service will be error-free.

What we are not liable for. To the extent the law allows, we are not liable for:

indirect, incidental or consequential losses;
lost profits, lost deals or lost data.

Liability cap. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim, or US $100.

Exceptions. Nothing in these terms limits liability that cannot be limited by law, or liability for our fraud or gross negligence.

11. Changes to these terms

We may update these terms. We will change the date above and, for material changes, email account holders before they take effect. If you keep using Listenback after that, you accept the new terms.

12. Governing law and disputes

Before starting any formal dispute, email us so we can try to solve it informally within 30 days.
